Summary

BCBS North Dakota is implementing new federal requirements for substance use disorder patient record confidentiality (42 C.F.R. Part 2). Providers who treat, diagnose, or refer patients for substance use disorders must obtain specific patient consent using BCBSND's provided form. This becomes a mandatory condition for continued participation in provider agreements.

Action Required

Action needed
Before February 16, 2026: All providers who treat, diagnose, or refer patients for substance use disorders must implement the new consent process using BCBSND's online consent form (https://www.bcbsnd.com/content/dam/bcbsnd/documents/forms/providers/Confidentiality-of-Substance-Use-Disorder-Consent.pdf). Update intake procedures to include this consent form for all SUD-related services. Review Provider Manuals for additional compliance requirements. Failure to comply will result in termination from BCBSND provider network.
